KPRDO asks FDA to take action against Swiggy & PharmEasy for drug delivery in 10 minutes

LEAD2_kprdo.jpgThe Karnataka Pharma Retailers and Distributors Organization (KPRDO) has now asked the newly formed Karnataka Food and Drug Administration (FDA) to immediately look into the issue of dangerous drug delivery with potential antimicrobial resistance of medicines with the partnership between Swiggy Instamart & PharmEasy and other illegal e-pharmacies.
 
In a letter to FDA Commissioner K Srinivas and the state drugs control licensing authority BP Arun, KPRDO said that such partnership is in gross violation of the Drugs & Cosmetic Act & Rules.

C Jayaram, president, KPRDO, stated as representatives of state chemists organization, working towards the betterment of pharma fraternity in Karnataka state, under the style and banner, now we have a serious concerns regarding a partnership involving Swiggy Instamart and PharmEasy aimed at medicine delivery in 10 minutes, which violates the drug laws of the state.

Vending medicines is the sole responsibility of the qualified and registered pharmacists governed by Drugs Control Act. Pharmacists will take utmost care in reviewing the prescription and analysing combinations in case of doubts in rationality of prescribed drug combinations and even check back with the medical practitioners to ensure wrong medications are not sold to the patients.

The dangerous partnership between Swiggy Instamart and PharmEasy bypasses all professional practice and treats medicine dispensing as a fast delivery model like FMCG DELIVERY. Chapter IV of section 18C of Drugs and Cosmetic Act, violated by Swiggy Instamart and PharmEasy, is a penalising action and we urge your kind self to initiate appropriate action on both the firms, he said.

Even Chapter IV of Section 18(c) in the Drugs and Cosmetic Act 1940 clearly says manufacture for sale or for distribution, or sell, or stock or exhibit or offer for sale, or distribute any drug or cosmetic, except under, and in accordance with the conditions of, a licence issued for such purpose, said Jayaram.

Swiggy Instamart without having prescribed licence under 18(c) of Drugs and Cosmetic Act 1940 flouted all the laws and offered for sale of medicines by giving advertisement in papers and social media is a punishable offence.

As express delivery of medicines compromises quality sale of medicines, instead may also indirectly prioritize sale of substandard, counterfeit and chances of dispensing expiry drugs also cannot be ruled out as concentration is only on speed delivery rather than quality dispensing of medicines, may prove fatal to patients, he said.

We request your kind self to intervene and initiate appropriate action on all e-pharmacies firms, as they violated licensing conditions of Drugs and Cosmetic Act 1940.  We also request you to speak to Information Technology Ministry and initiate appropriate action on all direct and indirect advertisements regarding sale of medicines in social media, television, Facebook, Instagram & newspapers in the state of Karnataka, in the interest of public health. There is also a need to take stringent action on Swiggy Instamart and PharmEasy and other illegal e-pharmacies and help Karnataka to set an unbiased standard for drug dispensing in India, stated Jayaram.
