A FLAWED DECISION

The Union Health Ministry has recently amended the recruitment rules for appointment of Drugs Controller General of India (DCGI) and has revised the eligibility and qualification criteria. The new recruitment rules supersede the Central Drugs Standard Control Organisation [Drugs Controller (India)] Recruitment Rules, 2011. One of the major revisions in terms of recruitment rules compared to the 2011 rules is in terms of qualification of the candidate. While the 2011 rules allow graduate degree in pharmacy or pharmaceutical chemistry or in Medicine with specialisation in clinical pharmacology or microbiology from recognised university in India to apply for the post, the amended rules stipulate that the candidates should have master's degree in certain courses for eligibility. The new recruitment rules allow candidates with master’s degrees in fields ranging from Biomedical and Chemical Engineering to Computer Science and Life Sciences to apply for the position. With this notification, even engineering qualifications are also eligible to the post of DCGI under the pretext of ‘manufacturing, testing or regulatory experience in medical devices’. Since the government did not agree to create a separate administration for medical devices and diagnostics which was a demand by this sector, this change in qualification for DCGI post must be driven by the fact that manufacture and testing of devices involve knowledge of engineering aspects. Of course, the DCGI’s role is of critical importance in safeguarding drug quality, fast tracking approvals, and ensuring alignment with global standards. A candidate with hands-on expertise in regulatory science and a clear comprehension of evolving compliance frameworks will be better positioned to navigate complex approval processes, strengthen oversight, and support innovation while maintaining patient safety.

Quite expectedly, the Union Health Ministry’s decision has come in for severe criticism from none other than the Drugs Control Officers (I) Welfare Association (DCOIWA), which is the national body of drug regulatory officers in the country, and the Drug Inspectors Welfare Association (DIWA). Labelling the amendment as a serious policy lapse, the associations argue that the amended regulations appear to dilute the essential technical and professional requirements for heading the country’s apex drug regulatory authority. The associations have cautioned that such a move could weaken the national drug regulatory framework and damage India's global reputation as a reliable pharmaceutical hub. It may be noted here that when the then Union Cabinet under then Prime Minister late Rajiv Gandhi decided to upgrade the designation from Drugs Controller India (DCI) to DCGI in the late 80’s, the government had mandated a qualified pharmacy professional to head this position. Dr Prem Gupta was the first qualified pharmacy person with years of experience in drug regulatory work who was appointed as the DCGI after this decision. There can be no two opinions about the fact that the DCGI is not merely an administrative head, he or she is the scientific guardian of India’s vaccines, medical devices, and pharmaceutical standards. Naturally, this role demands an uncompromising foundation in pharmacy, specifically at the M Pharm and PhD levels.  No doubt, as the position of DCGI requires scientific expertise and not just administrative prowess, any move to appoint individuals lacking a core pharmacy background will undermine the integrity of the drug regulatory system and will pose a serious risk to public health. There is a need to prioritize technical competence and career drug regulatory experience to safeguard public health and to uphold India’s standing in the global market. The Union Health Ministry should revisit its decision as the safety of public at large is at stake.
