DGTR reviews anti-dumping investigation on imports of siloxane polyoxyalkylene copolymers from china

The Directorate General of Trade Remedies (DGTR) is currently reviewing the scope of the Product Under Consideration (PUC) and Product Control Numbers (PCN) methodology in an ongoing anti-dumping investigation concerning imports of siloxane polyoxyalkylene copolymers from China.

PUC refers to the specific product being investigated for dumping allegations, which, in this case, is "Siloxane polyoxyalkylene copolymers having viscosity up to 2500 cst."  PUC is a standard term used in trade investigations to describe the goods subject to scrutiny regarding their import pricing, potential dumping practices, and impact on the domestic industry.

Siloxane polyoxyalkylene copolymers are a type of block copolymer that are also known as silicone polyoxyalkylene copolymers, siloxane polyethers, polyalkylene oxide silicone copolymers, or dimethicone copolyol. Siloxanes are used in cosmetics and some soaps.

PCN is a classification tool often used in anti-dumping investigations to differentiate between various types or grades of the PUC. Each PCN typically represents a distinct variation of the product based on specific characteristics such as physical properties (e.g., viscosity, density), chemical composition, end-use applications and production process.

This categorization allows for a more detailed analysis of pricing, costs, and competition for each variant of the product. By using PCNs, authorities can better compare imported goods with domestically produced equivalents, ensuring a fair assessment of dumping margins and injury to the domestic industry.

In the case of siloxane polyoxyalkylene copolymers, PCNs might be assigned based on viscosity ranges, application types, or other relevant parameters to facilitate precise investigation.

The investigation has been brought forward by Momentive Performance Material (India) Pvt. Limited, representing the domestic industry.

The applicant alleges that Chinese exporters are dumping these goods in India at unfairly low prices, causing material injury to the domestic industry.

Imports from the USA were initially considered but excluded due to de-minimis levels, leaving China PR as the sole focus of the probe.

The investigation is in accordance with Section 9A of the Customs Tariff Act, 1975, and the Anti-Dumping Rules, 1995. The DGTR will assess the dumping margin by comparing ex-factory normal value and export prices and evaluate its impact on the domestic industry.

Stakeholders, including importers, exporters, and domestic producers, are invited to participate by submitting relevant information to the Authority. Non-cooperation may result in findings based on available data.

Interested parties may submit information on a confidential basis, accompanied by a non-confidential summary. The DGTR emphasizes transparency and encourages compliance with the established guidelines for filing submissions.

The DGTR will determine whether anti-dumping duties should be recommended to mitigate injury to the domestic industry, ensuring fair competition in India’s market.
